Alberta is taking Ottawa to court, saying the federal government has failed to follow through on necessary changes to a law governing resource development.

OTTAWA — Alberta Premier Danielle Smith said Thursday she’s once again taking Ottawa to court over the revised Impact Assessment Act , saying that amendments made to the federal legislation earlier this year don’t make it constitutional.

Alberta’s government has taken legal action against the federal government’s amended Impact Assessment Act, referring the matter to the Court of Appeal of Alberta. This move follows a decision by the Supreme Court of Canada in October 2023,

The province contested the act from the outset and the Supreme Court of Canada, in a 2023 non-binding opinion, advised that Ottawa overstepped its constitutional authority

The federal Impact Assessment Act determines whether major resource projects should be approved based on the environmental, economic or social impact each project might have.

Alberta is going to court against Ottawa again, now totalling 10 cases on everything from guns to oil. The province added to that list Thursday, announcing a new lawsuit claiming Canada’s amendments to the impact assessment act are both bad for oil and gas and still tread on Alberta’s turf.
